TERMS OF GAS SUPPLY
Price and order of payments.
In accordance with part 2 of Article 12 of the Law of Ukraine "On the Natural Gas Market", natural gas is supplied at prices that are freely established between the supplier and the consumer, except in cases stipulated by this Law. Taking into account the above, the price for natural gas and the procedure for calculating the consumed gas are set by the parties in the Agreement (link) .
Rights and duties.
The rights and obligations of the Supplier and the Consumer are regulated by the provisions of the Law of Ukraine "On the Natural Gas Market" and "Natural Gas Supply Rules" (hereinafter - the Rules) according to which:
The supplier has the right:
to conclude an agreement on the supply of natural gas with any consumer and, in the absence of consumer overdue debts for natural gas, before the operating supplier, to supply natural gas to the consumer in the period following the period of supply of natural gas by the operating supplier;
to receive from the consumer timely payment for natural gas in accordance with the terms of the contract;
to unimpeded access (on presentation of a service certificate) to commercial gas metering units installed on the consumer gas supply facilities for the purpose of reconciliation of the actual consumption of natural gas;
the full and reliable information from the consumer with whom the contract was concluded, concerning the modes of consumption of natural gas;
to initiate the procedure for terminating (limiting) the supply of natural gas to the consumer in accordance with the terms of the contract for supply of natural gas and in accordance with the requirements of the Regulation;
other rights stipulated by these Rules and current legislation.
The supplier must:
to comply with the requirements of the Rules;
to ensure the supply of natural gas in conditions and in the volumes specified in the contract for supply of natural gas, subject to compliance by the consumer with the discipline of natural gas selection and payment for it;
Provide submission of all necessary documents for confirmation by the Operator of the GTS to the natural gas consumed by the consumer, provided that the consumer has fulfilled his obligations to the supplier for the ordering of the natural gas consumed by the consumer;
in the established manner, to consider consumer's inquiries regarding activities related to the supply of natural gas;
provide timely and reliable information to the consumer;
notify the consumer in a timely manner if the supplier is in the process of liquidation or bankruptcy, or the supplier is in the process of suspension / cancellation of the license for supply of natural gas, or its license for natural gas supply is canceled, or its operation is stopped and the lack of natural resource gas;
adhere to the minimum standards and requirements for the quality of service of natural gas consumers;
to perform other duties stipulated by the Rules and current legislation.
The consumer undertakes:
to comply with the requirements of the Rules;
to ensure observance of the discipline of selection (consumption) of natural gas in the volumes and on the terms specified by the agreements;
to pay in full time and in full for the supplied natural gas on the terms specified in the contracts;
to carry out a complex of measures aimed at preventing the emergence of a threat to life or injury, damage to equipment and products, negative environmental effects, etc. in case of receipt of notification of the termination (limitation) of the supply (distribution / transportation) of natural gas;
to ensure that the representatives of the supplier are admitted to the territory of their own facilities upon presentation of a service certificate to verify the actual consumption of natural gas;
to independently restrict (stop) the consumption of natural gas in the following cases:
violation of the terms of payment for the contract for the supply of natural gas;
lack or insufficiency of the certified amount of natural gas allocated to the consumer;
excess of daily allowance and / or monthly certified natural gas volume without agreement with the supplier;
absence of a signed contract for the supply of natural gas;
other cases stipulated by these Rules and current legislation.
The consumer has the right:
to the free choice of supplier
for receiving natural gas in the volumes determined by the contract for the supply of natural gas, subject to its conditions;
at the same time concluding several contracts for the supply of natural gas if its annual volume of natural gas consumption exceeds 30 million cubic meters. meters;
free of charge information on supplier prices for natural gas and payment order;
to independently stop (limit) the selection of natural gas for own needs, observing the requirements of the current legislation, about which all the entities of the natural gas market with which relevant contracts have to be notified in writing;
to demand the resumption of supply of natural gas in accordance with the established procedure after elimination of violations and compensation for payment for disconnection and connection if the termination of gas supply occurred without termination of the contract for supply of natural gas;
other rights stipulated by law.
Settlement of Disputes.
Controversial issues between the consumer and the supplier regarding the supply of natural gas, payment for the supplier's services, compensation, etc. should be resolved through negotiations, and in case of failure to reach agreement - in court.
The consumer and supplier are not restricted to the right to contact the Regulator or its territorial units for the relevant explanations regarding the application of the Rules and legal relationships in the natural gas market.
